| Merck & Co., after setting aside nothing to resolve liability over its Vioxx painkiller, may pay about $5 billion to settle claims that it hid the health risks of its withdrawn drug, three lawyers with direct knowledge of the accord said.
Merck, the third-largest U.S. drug maker, pulled Vioxx off the market in 2004 after a study showed it raised the risk of heart attacks in some patients. The company is facing more than 26,500 lawsuits filed by former users who claim the drug caused strokes and heart attacks.

An October 20, 2005, New York Times article, recapped Guidants history of selling defective defibrillators and pacemakers. The lengthy article highlights Guidants decision not to disclose its device defects to the general public or medical community, and to, moreover, continue providing defective devices to unsuspecting doctors and patients, even after they had fixed the defects in later models. With respect to the devices that had already been installed, Guidant took the position that replacement of the devices carried a higher risk from infection, than keeping the defective devices in the recipients. But Cardiologists feel that depends on the patient.

| The Food and Drug Administration (FDA) today issued a Public Health Advisory summarizing the agency's recent recommendations concerning the use of non-steroidal anti-inflammatory drug products (NSAIDs), including those known as COX-2 selective agents. The public health advisory is an interim measure, pending further review of data that continue to be collected.
